The company said that if it had worked together, the victims would have been "satisfied" with the compensation paid.

Chief executive Michael McBroom said in a statement this afternoon: "It is vital that the compensation process takes place quickly with a new approach to ensure the safety of the families we have helped."

He added that the company's case would be heard by Judge Michael Whelan.

The court has not ruled on a specific price as yet for the compensation, but will have to consider both the current legal costs and the legal cost of getting the process up and running in time for the 2015 financial year.

The trial is scheduled to start later this month.

Trainer devastated after appeal fails

A NSW judge has ordered an adult court judge to pay a man more than $100,000 after he was left devastated by an online appeal of his case.

The man, who cannot be named for legal reasons, won an appeal from the Southern District Court against his conviction for driving while disqualified, having the drug benzodiazepine substituted without his consent.

The NSW Court of Criminal Appeal in January 2015 found the prosecution was guilty of a criminal offence on two counts of possession of the drug and one count of failing to observe the warning signs.

Mr Jones is suing the NSW Court of Criminal Appeal for more than $2.6 million and an award of $20,000 in damages.

He is seeking damages including the cost of legal representation, the cost of rehabilitation, reasonable medical expenses, mental anguish, loss of dignity, damage to reputations and financial loss.

A case file for Mr Jones by the ABC has identified at least seven additional people who have also had similar situations.

The NSW Court of Criminal Appeal said it will be reviewing Mr Jones' decision.

The case heard that the judge failed to consider whether the man's lawyer should have raised the issue of his client's age at sentencing in his own defence of his guilty plea and, in fact, made comments that could have undermined his client's defence.

One of his barrister, Barry D'Aloisio, asked the court to hear what was in store for the man and "would the judge have taken that seriously?"

Mr D'Aloisio said that, even if his client had shown signs of maturity before the incident, it was "clear from the evidence that the defendant's mind was still young".

"He said that, with his mental capabilities, that he would not have been involved in that sort of incident to begin with," he said.

Another of Mr Jones' barrister, Richard Gillett, said there was no evidence of how the man, who is now 25, and other young people in NSW had known each other.

"It's a complex case," Mr Gillett said.

Another issue for Mr Jones would be whether he would have sought legal advice from a qualified lawyer if given a lower sentence, he said.

The court hearing is scheduled for January 21.
